KCLUXURY BAGS AND ACCESSORIES CONSIGNMENT CORP. (“KCLUXURYBAGS”) offers a Layaway Program to provide eligible Customers with the opportunity to reserve selected luxury items through scheduled installment payments before delivery.

Our Layaway Program is intended to provide flexibility while ensuring fairness to all parties. By reserving an item under the Layaway Program, KCLUXURYBAGS commits to reserving the selected item for the agreed period, while the Customer commits to completing all payments in accordance with these Layaway Terms & Conditions.

By enrolling in the Layaway Program, paying a reservation deposit, or otherwise proceeding with a layaway transaction, the Customer acknowledges that they have read, understood, and agreed to be bound by these Layaway Terms & Conditions together with our Terms & Conditions, Payment Terms & Conditions, Authentication Guarantee, Shipping & Delivery Policy, Return & Refund Policy, Privacy Policy, and all other applicable policies published by KCLUXURYBAGS.

1. Scope and Application

1.1 Coverage — These Layaway Terms & Conditions apply to every item reserved under the KCLUXURYBAGS Layaway Program, including luxury handbags, watches, jewelry, accessories, and any other Products expressly approved by KCLUXURYBAGS for layaway purchase.
1.2 Availability of the Program — The Layaway Program is offered solely at the discretion of KCLUXURYBAGS.

Not every Product may be eligible for layaway, and participation in the program may be limited by inventory availability, promotional campaigns, commercial considerations, or other operational requirements.
1.3 Relationship with Other Policies — These Layaway Terms & Conditions shall be read together with our Terms & Conditions, Payment Terms & Conditions, Shipping & Delivery Policy, Return & Refund Policy, Authentication Guarantee, Product Condition Guide, Privacy Policy, and all other applicable policies published by KCLUXURYBAGS.

Where another policy specifically governs a particular aspect of the transaction, that policy shall supplement these Terms. In the event of any inconsistency, the policy specifically applicable to the transaction shall prevail to the extent of the inconsistency.

2. Eligibility

2.1 Eligible Items — Only items specifically approved by KCLUXURYBAGS may be purchased through the Layaway Program.

Acceptance of one item into the Layaway Program shall not obligate KCLUXURYBAGS to approve future layaway requests.
2.2 Approval — Enrollment in the Layaway Program remains subject to the approval of KCLUXURYBAGS.

We reserve the right to decline any layaway request where necessary to protect our business, consignors, inventory, operational requirements, or other legitimate commercial interests.
2.3 Reservation of the Item — Once the required reservation deposit has been received and the layaway has been approved, KCLUXURYBAGS shall reserve the specific item identified in the layaway agreement for the agreed layaway period, subject to these Terms.

The reservation applies only to the identified item and shall not extend to any replacement, substitute, or similar Product.

3. Enrollment

3.1 Reservation Deposit — Enrollment in the Layaway Program requires payment of the reservation deposit communicated and agreed upon by KCLUXURYBAGS and the Customer.

The reservation deposit forms part of the total purchase price and is not an additional fee.
3.2 Confirmation of Enrollment — A layaway shall only be considered effective after:

the reservation deposit has been received; the payment has been verified by KCLUXURYBAGS; the item has been confirmed for reservation; and written confirmation has been issued by KCLUXURYBAGS.

Until these requirements have been completed, KCLUXURYBAGS reserves the right to accept other offers for the item.
3.3 Reservation Period — The duration of each layaway shall be the period agreed upon between KCLUXURYBAGS and the Customer at the time of enrollment.

Any extension of the agreed layaway period shall be subject solely to the prior written approval of KCLUXURYBAGS.

4. Reservation Deposit

4.1 Application of Deposit — The reservation deposit shall be applied toward the purchase price of the reserved item upon successful completion of the layaway.
4.2 Non-Refundability — Except where otherwise required by Applicable Law or where KCLUXURYBAGS expressly agrees otherwise in writing, the reservation deposit shall be non-refundable.

The Customer acknowledges that the reservation deposit compensates KCLUXURYBAGS for removing the item from active sale, reserving inventory, administrative work, and other commercial costs associated with the layaway arrangement.
4.3 Non-Transferability — The reservation deposit may not be transferred to another item, another transaction, or another person without the prior written approval of KCLUXURYBAGS.
4.4 No Exchange of Reserved Item — Enrollment in the Layaway Program applies only to the specific reserved item.

The Customer shall not be entitled to substitute, exchange, or replace the reserved item with another Product solely because of a change in preference after enrollment, unless KCLUXURYBAGS expressly agrees otherwise in writing.

5. Payment Schedule

5.1 Installment Payments — The remaining balance of the purchase price shall be paid in accordance with the installment schedule agreed upon by KCLUXURYBAGS and the Customer at the time of enrollment.

The Customer agrees to make each payment on or before its respective due date.
5.2 Payment Methods — All installment payments shall be made through payment methods approved by KCLUXURYBAGS and shall be subject to our Payment Terms & Conditions.

The Customer is responsible for ensuring that payments are made using accurate payment information and for retaining proof of payment until payment has been verified.
5.3 Payment Verification — A payment shall only be deemed received after it has been successfully verified by KCLUXURYBAGS.

Submission of a payment receipt or transaction reference does not automatically constitute confirmation that payment has been received or cleared.
5.4 Early Payment — The Customer may pay the outstanding balance in advance without penalty, unless otherwise provided in a specific promotional offer or written agreement.

Early payment does not automatically accelerate authentication, shipping, or delivery timelines, which shall remain subject to the applicable operational procedures of KCLUXURYBAGS.
5.5 Outstanding Balance — Legal ownership of the reserved item shall remain with KCLUXURYBAGS until the purchase price and all other applicable charges have been paid in full.

6. Customer Responsibilities

6.1 Timely Payments — The Customer shall make all installment payments on or before the agreed due dates.

Failure to make timely payments may constitute a default under these Terms.
6.2 Communication — If the Customer anticipates difficulty in making a scheduled payment, they are encouraged to notify KCLUXURYBAGS as soon as reasonably practicable.

Any accommodation or extension granted by KCLUXURYBAGS shall be entirely discretionary and shall not constitute a continuing waiver of future payment obligations.
6.3 Updated Contact Information — The Customer shall promptly notify KCLUXURYBAGS of any change to their contact information, including their mobile number, email address, or delivery address, throughout the duration of the layaway.

KCLUXURYBAGS shall not be responsible for delays arising from inaccurate, outdated, or incomplete contact information provided by the Customer.
6.4 Accurate Payment Information — The Customer shall ensure that every payment reference, proof of payment, account information, and supporting documentation submitted to KCLUXURYBAGS is complete and accurate.

Any delay resulting from inaccurate payment information shall not extend the Customer’s payment deadlines unless expressly approved by KCLUXURYBAGS.

7. Default and Missed Payments

7.1 Events of Default — A Customer may be considered in default under the Layaway Program where the Customer:
- fails to make an installment payment on its due date
- repeatedly fails to comply with the agreed payment schedule
- provides false or misleading payment information
- abandons the layaway without prior notice
- otherwise materially breaches these Layaway Terms & Conditions.
7.2 Effect of Default — Upon the occurrence of a default, KCLUXURYBAGS may, at its sole discretion:
- suspend the layaway
- cancel the layaway
- declare the remaining outstanding balance immediately due and payable
- release the reserved item for sale to another Customer
- exercise any other rights available under these Terms or Applicable Law.
7.3 Payments Previously Made — Except where otherwise required by Applicable Law or expressly agreed by KCLUXURYBAGS in writing, all payments previously made, including the reservation deposit and installment payments, shall be non-refundable upon cancellation resulting from the Customer’s default.

The Customer acknowledges that such payments compensate KCLUXURYBAGS for reserving inventory, administrative work, opportunity costs, marketing restrictions, and other commercial losses associated with the layaway arrangement.
7.4 Reinstatement — Following a cancellation due to default, KCLUXURYBAGS shall have no obligation to reinstate the layaway.

Any request for reinstatement shall be considered solely at the discretion of KCLUXURYBAGS and shall be subject to the availability of the reserved item and any conditions that KCLUXURYBAGS may reasonably impose.

8. Cancellation

8.1 Voluntary Cancellation — The Customer may request cancellation of a layaway at any time before full payment has been completed.

Such cancellation shall remain subject to the provisions of these Layaway Terms & Conditions concerning non-refundable payments and other applicable charges.
8.2 Cancellation by KCLUXURYBAGS — KCLUXURYBAGS reserves the right to cancel a layaway where:
- the Customer commits a material breach of these Terms
- fraudulent or suspicious payment activity is identified
- the Customer becomes unreachable despite reasonable attempts at communication
- continued performance of the layaway becomes unlawful or commercially impracticable
- cancellation is otherwise reasonably necessary to protect the interests of KCLUXURYBAGS, its clients, consignors, or business operations.
8.3 Effect of Cancellation — Upon cancellation of the layaway:
- the reserved item may immediately be returned to active inventory or otherwise made available for sale
- the Customer shall lose any right to reserve or purchase the item under the cancelled layaway
- any refund shall be governed exclusively by these Terms and Applicable Law.

9. Item Availability

9.1 Reservation of the Specific Item — The Layaway Program applies solely to the specific item identified and confirmed by KCLUXURYBAGS at the time of enrollment.

The reservation shall not entitle the Customer to any substitute, replacement, upgrade, or alternative Product unless KCLUXURYBAGS expressly agrees otherwise in writing.
9.2 Price Protection — Upon approval of the layaway, the agreed purchase price of the reserved item shall remain fixed for the duration of the approved layaway period, provided the Customer fully complies with these Layaway Terms & Conditions.

The agreed purchase price shall not be adjusted due to subsequent changes in market value, exchange rates, resale prices, supplier pricing, or other market conditions, unless otherwise mutually agreed in writing.
9.3 Consigned and Limited-Availability Items — Certain items offered under the Layaway Program may be consigned by third-party owners or may otherwise be subject to limited availability.

If, before completion of the layaway, the reserved item becomes unavailable due to circumstances beyond the reasonable control of KCLUXURYBAGS, including but not limited to authenticity concerns, legal restrictions, force majeure events, inventory discrepancies, damage, loss, withdrawal by the consignor where legally required, or other unforeseen circumstances, KCLUXURYBAGS may, at its sole discretion:
- cancel the layaway and refund all payments received
- offer a comparable alternative item, subject to availability
- propose another commercially reasonable resolution acceptable to both parties.
Nothing in this Section shall obligate KCLUXURYBAGS to provide a replacement item where none is available.
9.4 Authentication and Final Verification — Authentication, quality inspection, inventory verification, and final condition checks may be conducted before, during, or upon completion of the layaway period, depending on operational requirements.

If the reserved item fails authentication, cannot be verified to the standards of KCLUXURYBAGS, or is subsequently determined to be unavailable for lawful sale, KCLUXURYBAGS reserves the right to cancel the layaway and provide the remedies set forth under these Terms.

10. Delivery and Release of the Item

10.1 Full Payment Required — The reserved item shall only be released after KCLUXURYBAGS has verified receipt of the full purchase price together with any other applicable charges.

Until such time, ownership, possession, and control of the item shall remain exclusively with KCLUXURYBAGS.
10.2 No Partial Release — Prior to full payment, KCLUXURYBAGS shall have no obligation to release the reserved item or any component associated with it, including but not limited to its box, dust bag, accessories, lock, keys, straps, certificates, authenticity documents, receipts, promotional gifts, complimentary items, or any other accompanying materials.
10.3 Shipping and Delivery — Following verification of full payment, shipment or delivery shall be arranged in accordance with the Shipping & Delivery Policy of KCLUXURYBAGS.

Applicable authentication procedures, quality inspections, and operational processing shall be completed before dispatch.

11. Limitation of Liability

11.1 Commercial Nature of the Program — The Layaway Program is offered as a commercial accommodation to assist Customers in purchasing eligible luxury items through scheduled payments.

Except as expressly provided by Applicable Law, KCLUXURYBAGS shall not be liable for indirect, incidental, consequential, exemplary, or special damages arising from or relating to the Customer’s participation in the Layaway Program.
11.2 Communication — KCLUXURYBAGS may communicate with the Customer using the contact details provided during the layaway transaction, including through email, telephone, SMS, Viber, WhatsApp, Instagram, Facebook Messenger, or other reasonable communication channels.

The Customer is responsible for ensuring that such contact information remains accurate and accessible throughout the layaway period. KCLUXURYBAGS shall not be responsible for missed communications resulting from outdated, inaccurate, or inactive contact information.
11.3 Promotional Offers — Any promotional pricing, discounts, complimentary items, waived fees, vouchers, gifts, or other promotional benefits associated with a layaway transaction shall remain subject to the Customer’s continued compliance with these Terms.

Upon cancellation, default, or termination of the layaway, KCLUXURYBAGS reserves the right to withdraw or cancel any promotional benefits that have not yet been fulfilled, unless otherwise required by law or expressly agreed in writing.

12. General Provisions

12.1 Governing Law — These Layaway Terms & Conditions shall be governed by and construed in accordance with the laws of the Republic of the Philippines.
12.2 Amendments — KCLUXURYBAGS reserves the right to amend these Layaway Terms & Conditions from time to time. Any amendments shall apply prospectively upon publication on the official KCLUXURYBAGS Website or through other appropriate communication channels.
12.3 Severability — If any provision of these Layaway Terms & Conditions is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
12.4 No Waiver — Any failure or delay by KCLUXURYBAGS in exercising any right or remedy under these Terms shall not constitute a waiver of that right or remedy, nor shall any partial exercise prevent the further exercise of that or any other right.

Any waiver shall be effective only if made expressly in writing by KCLUXURYBAGS.
12.5 Survival — Any provisions which by their nature are intended to survive the completion, cancellation, or termination of the layaway, including but not limited to provisions relating to payments, refunds, limitation of liability, dispute resolution, governing law, confidentiality, and other continuing obligations, shall remain valid and enforceable to the extent permitted by Applicable Law.
