Introduction At KCLUXURY BAGS AND ACCESSORIES CONSIGNMENT CORP. (“KCLUXURYBAGS”), we recognize that purchasing a luxury item is a considered decision that often requires an in- person inspection before a purchase is made. At the same time, every item entrusted to our care represents significant financial and sentimental value, whether it forms part of our own inventory or has been entrusted to us by a consignor. This Bag Viewing Policy is intended to provide a safe, secure, and professional viewing experience while protecting the condition, authenticity, and value of every luxury item under our custody.
It establishes the rights, responsibilities, and expectations of both KCLUXURYBAGS and every individual attending a viewing appointment. By requesting, scheduling, attending, or participating in a viewing appointment, each visitor acknowledges that they have read, understood, and agree to be bound by this Bag Viewing Policy together with our Terms & Conditions and all other applicable Policies published by KCLUXURYBAGS.
1. Scope and Application
- 1.1 Coverage — This Bag Viewing Policy applies to every in-person viewing, inspection, or presentation of luxury handbags, watches, jewelry, accessories, and other luxury products arranged by KCLUXURYBAGS. It applies regardless of whether the item forms part of KCLUXURYBAGS’ inventory, is offered through our consignment program, or is otherwise under our custody for sale.
- 1.2 Persons Covered — This Policy applies to every prospective buyer, client, representative, companion, family member, assistant, or any other individual attending or participating in a viewing appointment. The person requesting the appointment shall remain responsible for ensuring that every accompanying individual complies with this Policy.
- 1.3 Relationship with Other Policies — This Bag Viewing Policy shall be read together with our Terms & Conditions, Product Condition Guide, Authentication Guarantee, Shipping & Delivery Policy, Consignment Terms & Conditions, Return & Refund Policy, Privacy Policy, and all other applicable Policies of KCLUXURYBAGS. Where another Policy specifically governs a particular aspect of the transaction, that Policy shall supplement this Policy. In the event of any inconsistency, the Policy specifically applicable to the transaction shall prevail to the extent of the inconsistency.
2. Viewing Appointments
- 2.1 Appointment Basis — All viewings are conducted strictly by prior appointment and remain subject to the availability of the requested item, the availability of our personnel, operational requirements, and security considerations. Submitting a request for a viewing does not automatically guarantee that an appointment will be approved.
- 2.2 Appointment Confirmation — A viewing appointment shall only be considered confirmed upon written confirmation issued by KCLUXURYBAGS through our official communication channels. KCLUXURYBAGS reserves the right to assign the viewing schedule, duration, and location based on operational requirements.
- 2.3 Rescheduling and Cancellation — KCLUXURYBAGS may reschedule, relocate, postpone, or cancel a viewing appointment where reasonably necessary due to circumstances including, but not limited to:
- prior sale of the item
- withdrawal of a consigned item
- authentication procedures
- operational requirements
- safety or security concerns
- transportation delays
- force majeure events
- any other circumstance that makes the viewing impractical or inappropriate.
Where reasonably possible, KCLUXURYBAGS shall notify the client and arrange an alternative appointment. - 2.4 Late Arrivals and No-Shows — Clients are encouraged to arrive at the agreed appointment time. Where a client arrives substantially late or fails to attend without prior notice, KCLUXURYBAGS reserves the right to shorten, reschedule, or cancel the viewing appointment to accommodate other operational commitments.
3. Viewing Locations
- 3.1 Approved Viewing Locations — Viewing appointments shall be conducted only at locations approved by KCLUXURYBAGS. Depending on the nature of the item, operational requirements, and security considerations, viewings may be arranged at our showroom, designated business premises, approved partner locations, or other locations determined by KCLUXURYBAGS.
- 3.2 Determination of Venue — KCLUXURYBAGS reserves the right, at its sole and absolute discretion, to determine the most appropriate viewing location for each appointment. In selecting a venue, we may consider factors including the value of the item, security risks, accessibility, staffing requirements, the nature of the transaction, and the overall safety of our clients and personnel.
- 3.3 Changes to Viewing Location — KCLUXURYBAGS may change the agreed viewing location prior to the appointment where reasonably necessary due to operational, logistical, or security considerations. Where practicable, reasonable notice of any change shall be provided to the client.
- 3.4 Right to Refuse Certain Locations — KCLUXURYBAGS reserves the right to decline requests for viewings at locations that we reasonably consider unsafe, impractical, or inconsistent with our operational policies. Our decision regarding the suitability of a viewing location shall be final.
4. Identity Verification
- 4.1 Verification of Identity — To protect our clients, consignors, personnel, and inventory, KCLUXURYBAGS may require prospective buyers or attendees to provide reasonable proof of identity before or during a viewing appointment. Verification may include the presentation of a valid government-issued identification card, confirmation of contact details, or other reasonable verification measures considered appropriate under the circumstances.
- 4.2 Representatives and Companions — Where a viewing is attended by a representative, assistant, family member, companion, or any other accompanying individual, KCLUXURYBAGS may likewise require reasonable identification from such persons. The client requesting the appointment remains responsible for the conduct of every person accompanying them during the viewing.
- 4.3 Refusal of Verification — Where an individual refuses or fails to comply with reasonable identity verification procedures, or where KCLUXURYBAGS reasonably believes that the information provided is inaccurate, misleading, or insufficient, we reserve the right to refuse, postpone, or terminate the viewing appointment without liability.
- 4.4 Suspicious or Fraudulent Activity — KCLUXURYBAGS reserves the right to immediately refuse or discontinue any viewing where we reasonably suspect fraud, identity misrepresentation, attempted theft, unlawful conduct, or any activity that may compromise the safety of our personnel, clients, consignors, or inventory. Nothing in this Policy limits KCLUXURYBAGS from taking any further action permitted under Applicable Law.
5. Pre-viewing Inspection and Documentation
- 5.1 Inspection Prior to Viewing — Before a viewing appointment begins, KCLUXURYBAGS may conduct a detailed inspection of the item to verify its overall condition, completeness, accessories, serial numbers, date codes, hardware, packaging, and any other identifying characteristics considered relevant. This inspection establishes the condition of the item immediately prior to the viewing appointment.
- 5.2 Documentation — KCLUXURYBAGS may photograph, video record, measure, or otherwise document the item and its accompanying accessories before and after every viewing appointment. Such documentation may include visible imperfections, identifying features, authenticity markers, packaging, receipts, certificates, dust bags, boxes, straps, locks, keys, and other inclusions. These records shall serve as the official reference regarding the condition and completeness of the item during the viewing process.
- 5.3 Inventory Verification — Where applicable, KCLUXURYBAGS may verify all accompanying accessories and inclusions before and after the viewing appointment to ensure that every component originally presented remains complete and accounted for. Should any discrepancy be identified, KCLUXURYBAGS reserves the right to suspend the viewing while the matter is investigated.
- 5.4 Right to Suspend Viewing — If, before or during the viewing, KCLUXURYBAGS discovers any discrepancy relating to the condition, completeness, authenticity, or security of an item, we may immediately suspend or terminate the viewing pending further inspection or investigation. Such suspension shall not constitute a breach of any obligation owed to the prospective buyer.
6. Handling of Luxury Items
- 6.1 Standard of Care — All luxury items presented during a viewing shall be handled with the highest degree of care and respect appropriate for high-value luxury goods. Every attendee is expected to exercise reasonable caution while inspecting an item and to follow all instructions provided by KCLUXURYBAGS personnel throughout the viewing.
- 6.2 Proper Handling — Luxury items shall only be handled in a careful and responsible manner. Visitors shall avoid any action that may unnecessarily expose an item to scratches, stains, pressure, deformation, contamination, or other avoidable damage. Where instructed by our personnel, an item shall remain on its protective surface or shall only be handled while seated or within the designated viewing area.
- 6.3 Prohibited Conduct — To preserve the condition and value of every luxury item, visitors shall refrain from engaging in any conduct that may reasonably increase the risk of damage. This includes, but is not limited to:
- placing items on the floor or other unsuitable surfaces
- exposing items to food, beverages, cosmetics, perfumes, lotions, ink, or other substances that may stain or damage the item
- forcing zippers, locks, closures, straps, or hardware beyond their normal operation
- bending, folding, twisting, or applying unnecessary pressure to leather or structural components
- removing protective films, stickers, seals, or protective coverings
- using sharp objects or tools near the item
- placing personal belongings inside the bag that may scratch, stretch, or stain the interior
- engaging in any other conduct that KCLUXURYBAGS reasonably believes may compromise the item’s condition
- 6.4 Compliance with Instructions — Visitors shall promptly comply with all reasonable instructions given by KCLUXURYBAGS personnel concerning the handling, inspection, or return of an item. Where our personnel determine that continued handling presents an unnecessary risk to the item, KCLUXURYBAGS may immediately require the item to be returned without further inspection.
- 6.5 Children and Accompanying Persons — Children shall remain under the direct supervision of the accompanying adult at all times during the viewing. KCLUXURYBAGS reserves the right to prohibit any individual, including accompanying persons, from handling an item where we reasonably believe that doing so may compromise the safety or condition of the item.
7. Authentication During Viewing
- 7.1 Purpose of the Viewing — A viewing appointment is intended to allow prospective buyers to personally examine the item’s overall appearance, craftsmanship, size, color, functionality, condition, and other visible characteristics before making a purchasing decision. A viewing appointment is not intended to serve as an authentication session or forensic examination of the item.
- 7.2 No Destructive or Invasive Inspection — Visitors shall not perform or attempt to perform any inspection method that may alter, damage, dismantle, or otherwise compromise the condition or integrity of the item. Without limitation, this includes:
- disassembling hardware or components
- attempting to remove stitches, screws, rivets, or hardware
- applying chemicals, solvents, cleaning agents, or testing substances
- scratching, scraping, bending, or manipulating materials beyond normal inspection
- using tools, measuring devices, or equipment that may damage the item
- performing any other invasive inspection that KCLUXURYBAGS reasonably considers inappropriate
- 7.3 Independent Authentication — Should a prospective buyer wish to obtain an independent authentication opinion before completing a purchase, any such request shall be subject to the policies and procedures of KCLUXURYBAGS. Nothing in this Policy obligates KCLUXURYBAGS to permit third-party authentication during a viewing appointment.
- 7.4 Right to Refuse Inspection Methods — KCLUXURYBAGS reserves the right to prohibit or discontinue any inspection method that, in our reasonable judgment, may compromise the safety, condition, authenticity, marketability, or value of an item. Our decision regarding the appropriateness of any inspection procedure shall be final.
8. Security Measures
- 8.1 Security Procedures — To safeguard our inventory, consigned items, personnel, and clients, KCLUXURYBAGS may implement reasonable security measures before, during, and after every viewing appointment. Such measures may vary depending on the value of the item, the nature of the transaction, and other operational considerations.
- 8.2 Documentation and Monitoring — KCLUXURYBAGS may photograph, video record, inspect, document, or otherwise monitor the condition and handling of an item before, during, and after a viewing appointment. Where available, viewing areas may also be monitored through closed-circuit television (CCTV) or other security systems for safety and security purposes.
- 8.3 Supervised Viewing — All viewings shall be conducted under the supervision of authorized KCLUXURYBAGS personnel. Visitors shall not remove, separate, or relocate an item from the designated viewing area without the express permission of KCLUXURYBAGS.
- 8.4 Inspection After Viewing — Immediately following the conclusion of the viewing, KCLUXURYBAGS may conduct a post-viewing inspection to verify the condition, completeness, and functionality of the item and all accompanying accessories. Where any discrepancy, damage, or irregularity is identified, KCLUXURYBAGS may suspend the conclusion of the appointment while the matter is investigated.
9. Damage, Loss, and Responsibility
- 9.1 Responsibility for Proper Handling — Every individual attending a viewing appointment is responsible for exercising reasonable care while inspecting any item presented by KCLUXURYBAGS. Any person who, through negligence, recklessness, intentional misconduct, or failure to comply with this Policy or the instructions of KCLUXURYBAGS personnel, causes damage to an item may be held responsible for the resulting loss, including the reasonable cost of repair, restoration, diminution in value, or replacement where appropriate.
- 9.2 Damage Caused by Viewers — Where damage is determined by KCLUXURYBAGS to have been caused by a viewer or any accompanying person during a viewing appointment, KCLUXURYBAGS reserves the right to seek reimbursement directly from the responsible individual. Nothing in this Policy prevents KCLUXURYBAGS from pursuing any additional remedies available under Applicable Law.
- 9.3 Damage Not Attributable to KCLUXURYBAGS — KCLUXURYBAGS shall not be responsible for any loss, damage, deterioration, or reduction in value arising from circumstances beyond our reasonable control, including but not limited to:
- accidental acts of third parties
- natural aging of luxury materials
- latent or hidden manufacturing defects
- force majeure events
- theft or criminal acts committed by third parties despite reasonable security measures
- any other circumstance not directly caused by the proven negligence or willful misconduct of KCLUXURYBAGS or its personnel
- 9.4 Burden of Determination — In the event of a dispute regarding damage allegedly sustained during a viewing appointment, KCLUXURYBAGS may rely upon its inspection reports, photographs, video recordings, inventory records, CCTV footage (where available), and other contemporaneous documentation in determining the condition of the item before and after the viewing.
10. Availability of Items
- 10.1 No Guarantee of Availability — Scheduling or attending a viewing appointment does not reserve, hold, or otherwise guarantee the availability of an item. Unless a written reservation or confirmed purchase agreement has been accepted by KCLUXURYBAGS, the item shall remain available for sale in accordance with our standard business practices.
- 10.2 Consigned Items — Items presented during a viewing may be owned by third-party consignors. Accordingly, KCLUXURYBAGS reserves the right to suspend, postpone, or cancel a viewing where a consignor withdraws the item, where the consignment expires, or where the item otherwise becomes unavailable.
- 10.3 Right to Decline a Sale — KCLUXURYBAGS reserves the right to decline, postpone, or cancel any proposed transaction where we reasonably believe that doing so is necessary to comply with Applicable Law, protect the interests of our clients or consignors, prevent fraud, address payment concerns, preserve the integrity of an authentication process, or safeguard the reputation and operations of KCLUXURYBAGS.
11. Rights of KCLUXURYBAGS
- 11.1 General Authority — To ensure the security of our inventory, consignments, personnel, and clients, KCLUXURYBAGS reserves the right to exercise reasonable control over every viewing appointment.
- 11.2 Protective Measures — Without limiting our other rights under this Policy, KCLUXURYBAGS may:
- limit the number of attendees participating in a viewing
- restrict the handling of particular items
- require that certain items remain under the supervision of our personnel
- conclude a viewing once sufficient inspection has been provided
- temporarily remove an item for inspection or verification
- refuse requests that may compromise the condition or security of an item
- implement additional security procedures where reasonably necessary
- 11.3 Immediate Termination — KCLUXURYBAGS may immediately terminate a viewing appointment without liability where a visitor:
- violates this Policy
- refuses to comply with reasonable instructions
- engages in abusive, threatening, or inappropriate conduct
- attempts to remove or conceal an item
- performs unauthorized authentication procedures
- creates an unreasonable risk of damage or loss
- otherwise compromises the safety or security of the viewing
12. Limitation of Liability
- 12.1 Nature of the Viewing — A viewing appointment is provided solely to assist prospective buyers in making an informed purchasing decision. Visitors remain responsible for conducting their own assessment regarding whether an item is suitable for their intended use.
- 12.2 No Warranty Created — Nothing occurring during a viewing appointment shall create any warranty, representation, or guarantee beyond those expressly provided in the applicable Policies of KCLUXURYBAGS.
- 12.3 Variations in Appearance — Visitors acknowledge that the appearance of luxury items may reasonably vary depending on lighting conditions, camera settings, display environments, viewing angles, and the natural characteristics of the materials used. Such variations shall not, by themselves, constitute defects or misrepresentation.
13. General Provisions
- 13.1 Governing Law — This Bag Viewing Policy shall be governed by and construed in accordance with the laws of the Republic of the Philippines.
- 13.2 Amendments — KCLUXURYBAGS reserves the right to amend this Policy from time to time. Any amendments shall apply prospectively upon publication on our official Website or upon written notice, where applicable.
- 13.3 Severability — If any provision of this Policy is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
- 13.4 No Waiver — Any delay or failure by KCLUXURYBAGS to exercise any right under this Policy shall not constitute a waiver of such right.
